Discipline & conduct

Do I have to follow the ACAS Code of Practice?

Answered by Samantha Newton FCIPD, Chartered Fellow CIPD · Last reviewed August 2026

The ACAS Code isn't legally binding, but tribunals take it very seriously. It's the standard your disciplinary and grievance processes get judged against, and an unreasonable failure to follow it can push a tribunal award up by as much as 25%.

In practice, treat it as the minimum. Follow it and your process holds up. Ignore it and you've handed the other side an easy win.
